Arizona is attempting to curb one of the highest driving under the influence (DUI) rates in the nation. The penalties recently enacted by the legislature under Chapter 4 of Title 28, are some of the toughest laws to be enacted by any state.
DUI is defined as a person having an alcohol concentration of 0.08 or more within two hours of driving or being in actual physical control of the vehicle. A commercial driver having an alcohol concentration of 0.04 or more is also considered to be driving under the influence. DUI is considered to be a Class 1 misdemeanor.
