Hasn't this form of affirmative action been abolished yet? It is exactly this type of thinking that makes race and gender bias so rife in the work place today.
US companies should be required to provide commensurate pay to qualified individuals, regardless of race or gender. Just because someone is female does not necessarily mean they are the best person for the job. This type of thinking is exactly what causes unqualified people to be placed in positions in which they don't belong.
A persons pay rate should be based on merit, not on gender or anything else. If you are capable of doing a job and doing it well you should be entitle to a fair salary. If you go above and beyond the requirements of the job you should be entitled to more than the prescribed salary. It's simple business tactics. You reward the over achievers and weed out the undesirables for a more efficient operating environment.
What should be illegal is discriminating against women who are as qualified or more qualified than a male counterpart. However, since we already have laws governing this type of discriminatory practice on the books there is little need to legislate this matter any further.
Companies are in business to make money. Provided they handle their employee relations in a fair and reasonable manner they should be left to their own devices with minimal government regulation. If they violate the existing anti-discrimination laws they should have the full weight of the US government come down on them. But to have a broad law that provides equal pay to men and women is overstepping the governments mandate and authority.
