Well being in this predicament myself I know a little about getting a divorce while you are pregnant. In my state of Texas you Can not get a divorce while you are pregnant. They want to name a father to the child even if your husband isn't the father of the child.

I filed for my divorce in February of 2007. My husband and I had a 2 year marriage and a son together. The only reason we did marry was because I was pregnant and I needed insurance. It was a very abusive relationship he had been to jail 3 times before I finally decided I was strong enough to leave.

I started seeing someone in March 2007 and became pregnant with his child in April. It was a total shock. I knew I was still legally married to my husband and didn't know how this situation would pan out.

My divorce would have been final November 2007 but because of my pregnancy it wasn't. My current boy friend (the father of this child) will have to sign her birth certificate to prove he is the father. Even then it is at the judges discretion to have a paternity test.

I could have been moving on with my life but because of this I can not. Even though we all know who the real father is we have to wait till she is born. So I guess my husband is legally responsible until one person says otherwise.
