Do you need a trust for your estate planning? Great question, however most people do not understand even the basic nature of the beast "Trust". There are multitudes of trusts in every state to choose from and unless you know the specific laws in each State, you are forced to hire an attorney and pay fees usually based on the size of your estate.
Perhaps your estate is small, maybe under $200,000. You don't need a trust. You can simply execute a Will and have specific provisions in your Will to distribute your estate "ANY WAY YOU WANT". Perhaps your estate is large, maybe over $1,000,000,000. You still don't need a trust. You should simply execute a Will and have specific provisions in the Will to once again, distribute your estate "ANY WAY YOU WANT".
Don't be fooled by attorney's charging huge amounts of money to talk you into a trust. Simple Wills have worked and been honored for decades in this country.
Let's stop the bureaucracy of trusts that go on forever and ever. If most people had basic Simple Wills, we would save thousands in legal fees and court fees. Remember, if everything in your Simple Will is straight forward and you leave your assets to another individual(s), you probably don't need to probate. Make sure you look at your assets like a joint checking account. Put the names of your heirs and/or friends on your assets and you'll never have to probate if everything is jointly owned!
Most Trusts end up being probated soooner or later. That's the point I'm making, trusts are for attorney's and courts to continue making income on for eternity. Wills may need be probated as well, but they are open and shut once distribution is made and do not continue to haunt your loved ones for years and years after your death.
