Of course they can! All it takes is enough people to vote for enough politicians to install enough judges so that the principles of our constitution can be violated. The stage is already set using Hate Crimes legislation as a tool.

In Madison, Wisconsin, David Ott, a former homosexual, was arrested for a "hate crime" for sharing his testimony with a homosexual at a gas station. He faced a $10,000 fine and one year behind bars. Seven thousand dollars in legal fees later, [he] was ordered to attend re-education classes at the University of Wisconsin conducted by a lesbian.

In St. Petersburg, Florida, five Christians including two pastors were arrested at a homosexual rally for stepping onto the public sidewalk instead staying in an officially designated "free speech zone."

In Elmira, N.Y., the police arrested seven Christians for praying in a public park where a homosexual festival was getting started.

It is only a short step from the enforcing these "Hate Crimes" in public venues to enforcing them within the walls of the church. And the tool that governments find easiest to use is threatening the tax exempt status of churches as non-profit organizations. All it takes is for enough people to elect enough politicians who appoint enough judges who don't mind.
