Evictions can be either simple or complex. If you are knowledgeable about the process, and the tenant is responsive - it can be a simple procedure; however, if the landlord does not follow the steps properly, or you have a difficult tenant - watch out, they might paint the entire place red, as they did my brother's apartment.
There are proper procedures for evicting a problem tenant; however, evicting has to be for the right reasons. You cannot create your own rason for evictions; believing tenants do not have rights - because they do! In fact, there are organizations that represent them, as there are who represent landlords.
The main reasons for evictions are as follows:
1) Failure to pay rent on the required time
2) Caused serious damage to premises
3) Violence, threats to health, safety of property and other tenants.
4) Illegal activities on premises as drugs or prostitution.
There is assistance for you on the Internet; some of whom are:
1) www.ca-evictions.com - They will give you a free copy of "Landlord's Guidebook to Evictions and Debt Collections."
2) www.safe4all.org - This is a forum support and discussion site. You can ask your question. People will respond as well as share their own experiences.
3) www.lawdepot.com - This site will actually make the eviction form for you. You just fill in the questions: state, your name, tenant's name, reason for eviction, if it is failure to pay rent, for example, include date rent was due, amount, etc. They will create the form for you for a cost of $14.95 as a single use license.
4) www.wikianswers.com - They list eviction steps as: a) file notices with courts, b) obtain a signed order from the courts, and c) have the Order delivered to the tenant by a designated official (each local law varies).
Hopefully, the tenant will follow the three-day notice; however, should you have problems; there are other steps you should follow. As a landlord, you should order the free landlord's guide mentioned previously to assist you. The sites listed will also advise you as to the next step in case you have a problematic tenant.
