The question of whether, or not a computer virus writer should go to jail is indeed not a difficult decision. We base most of our laws on whether, or not an individual is harmed physically, and or monetarily. In the case of computer virus writers, it is a case of monetary and property damage. In many instances it would be possible to charge these individuals under anti-fraud laws, as they generally fool individuals into perpetuating the virus under false pretenses. This could include such things as an email attachment stating that it is from an individual that the potential victim knows, or a link to a website that promises a product, or service.
We must consider as well the phishing and spyware scams as well. It is easy for us to categorize them as a lesser infraction, but are they really? No, in many instances they can be even more damaging to individuals than any virus. These phishing and programs steal an individuals personal information stored on their computer and is then used to gain fraudulent access to bank accounts, and sensitive personal data, such as social security numbers. Spyware on the other hand, has the ability to hijack an individual's computer and change the way that it would normally operate. It basically makes the computer useless to the user and eventually an Operating System reinstall is inevitable. This leads to time and assets being lost due to computer downtime. Consider that if these things were to happen to a large, or even small company, the effects would be devastating.
Therefore, let us categorize those individuals which author viruses, phishing, and spyware on the same level. They must all be prosecuted for the crimes they commit against innocent individuals trying to utilize technology to its utmost potential.
