Computer virus writers should go to jail, that is if you can catch them. Since different viruses deal different levels of damage, the sentence that is given to the virus writer should be just as high.

Viruses that steal information, money, identities, or pose as a legitimate service should be considered enough grounds to jail its creator. Stealing is stealing whether it's a candy bar from your corner store or a credit card number that was lifted from a computer by a virus so that the writer can go on a shopping spree.

Creating a virus that not only steals but disables running systems and spreads should also be considered as jail time if caught. The reason is because the writer is causing damage to systems that are relied upon by consumers and businesses. Making it spread only makes it harder to maintain and harder to kill. It's like starting a brush fire. Small at first but if left alone cans spread and do great damage to nearby homes, cities and wildlife. If arsons get jail time, a virus writer should get jail time as well.
