Credit disputes: Sample cease-and-desist letters that work

Credit disputes can be among the most stressful and frustrating experiences a person can go through. However, depending on the situation, one can gain better control of the dispute through the use of a cease-and-desist letter. When faced with a serious dispute about a debt, it is always prudent to seek the help of a professional. Those who feel so inclined to write their own letter can do so by using any of a variety of sample letters available for free to the public.

Situation #1: Debt is wrongly demanded by a creditor.

If a debt is being incorrectly collected, it can be disputed. This sample letter is provided by Los Angeles Bankruptcy Attorney at http://los-angeles-bankruptcy. net/cease_desist_letter_to_cre ditors.htm.

On (date), you or someone from your company contacted me about a debt. I do not believe that I owe this, and I dispute it.

In accordance with Section 809 of the Fair Debt Collection Practices Act, I am asking that you provide me, in writing, the following information:

1.what the money you say I owe is for
2.how you calculated this amount in a way I can understand
3.show me copies of papers where I agreed to pay what you say I owe
4.provide me with a copy of a judgement (if applicable)
5.identify the original creditor
6.demonstrate that you or your company is licensed in my state, and inform me of the license number.

Please provide this letter to the company for whom you are collecting so that they have notice of my dispute.

Furthermore, please inform any credit reporting agencies to which you've reported this debt that it is being disputed. I demand proof that you have done so.

Finally, cease and desist from contacting me in this and any and all related matters, except via United States Mail, and only then to inform me that you are terminating all efforts to collect or that you are taking specific court or legal action.

Situation #2: Choosing to pay the original creditor, rather than the collection agency demanding payment.

I will be thorough and pursue all criminal and civil claims against you and your company.

Be warned, that if any negative information pertaining to this debt is added to my credit file after receipt of this letter, I will file suit against you and your company, both personally and corporately, to seek any and all legal remedies afforded me by law.

I am not going to ever deal with collection agencies, and my intention is only to settle this account with the original creditor.
