To Whom It May Concern:

This letter is my legal cease-and-desist notice concerning account number 10432458901 in the amount of $4500 under my name Jane Doe at the address listed above.

You are hereby asked according to my rights under the FDCPA, (Federal Fair Dept Collection Practices Act) to stop all telephone communication with me concerning above account number and debt associated with that account, or you may face legal action. Under law, I have the right to sue your company within a years' time if your company is found to be in violation of the Federal Fair Debt Collection Practices Act (FDCPA).

Not only, if you do not cease from contacting me, and if you choose to continue, I will contact the Federal Trade Commission and the American Collectors association. Furthermore, if your company is found guilty of barred behavior, your company will be responsible for all monies associated with recovery, plus attorney and court fees.

The measures you have used to collect the amount claimed is not appropriate. Under law, companies are barred from using certain behaviors in order to collect debt. Calling several times a day and threatening me, is against the law. The technique you are using to collect debt is a form of harassment. I would advise you to review your company policy regarding such behavior in order to prevent a future lawsuit.

I dispute this debt; and this letter will serve as my formal dispute. At this time, I request in writing all information pertaining to this debt and why you feel that I am responsible for this debt. Please send me all the information you have regarding this debt, as well as all signatures, applications, bills and any other pertinent information regarding this account.

Furthermore, I tried to explain when your office first called that it was the first time I had heard of the debt. Since then I have found out that I am the victim of identity theft and I believe the charges associated with that account are not mine and I have no record of the transactions associated with the debt..

I have since contacted the credit bureaus with my dispute and you should be receiving formal notice of the investigation of my account from the credit bureau.

If any such wrongful information is placed in my credit report because of your actions against me, you will be held responsible under the FDCRA (Federal Fair Credit Report Act).

Please mail all pertinent information regarding this account to the above address attention my name as soon as possible and do not call me or any other parties regarding this debt.

I appreciate your understanding of this difficult circumstance and I look forward to viewing the documents that you have in place against me.
