A child is handicapped for life due to doctor neglect at birth. This child, right out of the womb, now has significantly fewer opportunities than does his normal birth counterpart just down the hall. The handicapped child potentially looks at a lifetime of extensive therapy, surgeries, and special accommodations to do simple things like walking, driving and getting around. Caps on lawsuits and limits on punitive damages only protect the negligent doctor and offer no assurance to the family of the disabled child that they will be able to support the needs of this child throughout his entire life. Tell me how that is fair that a doctor gets off with a slap on the wrist for damaging a child for LIFE? I understand that accidents happen, but the amount of damages should be left to a jury to decide. We don't need insurance companies representing doctors sending lobbyists to Washington to plead the case of the poor, poor negligent doctor. A negligent doctor should be required to pay for the negligence he or she is responsible for, and that includes punitive damages.
