Exporting: Investigating trade restrictions by your government

Every country has controls as far as its exporters are concerned. Before going into the business it is necessary to have a full understanding on the government imposed limitations that will hover over your business at all times.... I can only speak for how it is in America, since that is where I live, but I'm sure every country's situation is merely a variation on this one.

The organization that controls our export laws and their enforcement in this country is the Bureau of Industry and Security. They are charged with enforcing the Export Administration Regulations. this organization does not regulate all exports and there are some other agencies for more specialized ones but this is still the biggest of its kind.

One thing you need to determine is if you need a commerce export license. This only applies to a small percentage of items such as lasers, marine technology and chemical materials. Obviously anything dangerous requires you to sign off on it so that any paper trail leads back to you...

Make sure to classify your item as "Systems", "Material", "Test Equipment", "Software" or "Technology". These are the five major classifications of export and yours must be properly identified.

Check to make sure your export item is on the Commerce Control List. If it is not then you may be required to get a license.

The question of where you are exporting is important as well as who will receive your item. Once again, in most cases you need no license but there might be some dangerous situations where the government wants you to vouch for what you are doing...

There are a plethora of business laws that apply to exporters in America but the general rule of thumbs is that these things usually only apply to weapon technology and the like. Still, you need to check with these laws before you even think of getting started anywhere else.
