How to save money handling your legal affairs

The best way to handle your own legal problems is to avoid the conflict in the first place. However, we all know even the nicest people run into the most difficult situations from time to time. There are times when we each have to stand up for ourselves and for what is right.

Quite often a legal problem could have been avoided with a little communication from each party. If you are able to communicate with the other party on a professional level then you should try this first. Don't hesitate. You need to handle the situation before it escaltes.

Consider how the other party feels and try to negotiate a reasonable solution. Try to come up with a way that you will both be happy with the outcome. If you can come to a resolution get it in writing and have everyone involved sign the paper and have it witnessed.

If you can't work out a deal with the other party then you can try mediation. It is another way of communicating but brings in a third party that is not involved such as an attorney or trained mediator. You will each get to explain your side of the situation and the mediator will help everyone stay focused and calm. The mediator will not decide who is right or wrong but will attempt to help you come to a resolution. Mediation is cheaper than hiring an attorney.

There are several organizations designed to protect the consumer. It is helpful to familiarize yourself with these organizations and what they can do for you. The Better Business Bureau will help resolve conflicts. The attorney general is the governments state attorney for the consumer. They can often explain the route you should take regarding your particular situation. The Federal Trade Commission protects consumers from deceptive practices and enforces the law. In some cases they will file class action suits at no cost to you.

Get your documents in order to support your case. Documentation such as canceled checks, bills, receipts, warranties, photos, and contracts will be necessary if you end up in front of a judge.

Keep a record of each communication that you have about this problem. Document dates, times, and what was said. If you have letters keep those and the envelopes they were received in as well.

You can use arbitration to resolve the problem. An arbitrator acts like a judge to decide how the issue will be resolved. Generally any decision the arbitrator makes is final.

If you go to trial and you decide to do it without an attorney then it is entirely up to you to know how to prepare for your court date. You will need to file the proper paperwork with the court, meet their deadlines, and have your evidence submitted. When appearing in court dress appropriately, be polite, be breif, and be organized.

If the judge rules in your favor and this is regarding money then the judge can also decide if the other party will pay you one lump sum or installments. If you win it may be the beginning of your battle. If the other party decides not to pay you then you will have more work to do.

You could end up hiring a collection agency to collect your money. You may need to file papers to request the court's permission to place a lien on the other party's property. You could end up paying court costs to get bank accounts, wages, or taxes garnished. If the other party doesn't have anything of value you may be the ultimate loser. You could end up spending filing fees, court costs and wasting valuable time to find out that you can't collect the money the judge has ordered this person to pay.
