Injuries or illness that is a result of the military action is to be considered service connected and qualifies the person to be compensated. Compensation is for the soldier and their dependents as long as there was no dishonorable discharge. The number of dependents will also be used to determine the monthly amount also S.S.Iand V.S.I will affect the amount of benefits a disable veteran will receive.
Timing is everything in applying for disability compensation. There is a pilot program now that is in effect at 10 locations that promises to process claims in three (3) months. If disability is not applied for immediately after service you might have to go through a much longer process. Standard time on claims is six months. It is important to work with a VA worker at the veteran's service center. This person can be of great value in assisting you receive your benefits.
It is a very good thing to obtain as many of your medical records as possible before even attempting to apply for your benefits. Do this despite the VA have your records on file it is just good for you to have copies. Not only are the VA records important but private physician's records are important also. They are used to support your claim for disability.
You should be prepared to write a letter on your behalf explaining in your own word why you need compensation. You must carefully word your letter and be specific in describing you condition, your previous treatment. In addition to the letter that you write it would also help a great deal if a friend or family member would also write a letter. In their letter they might be able to give a more accurate description of your condition.
Remember you must try and be patient- you are working with the United States Department of Veterans Affairs. There will be test to evaluate your claim some time these test are done outside of the VA. Depending on your claim and type of injury claim you are seeking. With the number of claims they receive your response time for hearing back from the department of veteran affairs should take about six (6) months. That is excluding the notification letter letting you know that they are in receipt of your claim.
After the six months are up you will receive a letter and either you will have been denied or the percentage in which you have been evaluated is much lower than your injuries are. You think that it should have been more. And chances are you are correct. Appeal the decision immediately and go the most of the same process all over again. They will ask you if you have new evidence; supply them with the same information if you have nothing new to add. That is why your records are going to be important. It is good to safe keep your own records for your own purpose in case there is ever a mix-up.
If you are your claim is denied and no benefits are granted you have the right to appeal the ruling. You get the chance to present your case with or without an attorney. Most claims are denied the very first time.
