Should judges have the opportunity to look at the individual circumstances of a case before they detain and deport someone?

Deportation has nothing to do with due process

The reason the vote was no, was because the issue of deportation was involved. A detainer is a little different.

First off, the deportation. There should not be any illegal aliens in this country. We as a country make it extremely easy to become a citizen. If an illegal alien winds up in our prisons, and it is brought to the attention of the US Immigration, that this individual is an illegal alien. The alien should not be held longer in our prison system, because of a detainer elsewhere,the alien should be deported immediately.

Most times aliens will use an excuse that thier saftey is a reason for ecscaping thier home country. This in most cases isn't the truth at all. Most aliens, when concerning Mexico come into this country to strengthen the drug pipeline, and play on the generous American hearts, by making up a sad story.

How about our safety as Americans? When these illegal aliens "escape" their home country and come to the United States illegally, there is no record of the illegal alien's existance in our federal databases. However, they do live here. Now, when an immigrant becomes and American citizen legally. There is a photo, a set of fingerprints, and other personal information. Although personal information can be altered, and crime will never cease. When this process of immigration is completed, the census updates are more accurate, and the federal database has a description and fingerprint.

When the argument about a judge having the oppertunity to look at an individual case to analyze the circumstances before a detainer is set. This should not be done with an illegal alien that needs deported. Our constitutional and civil rights do not pertain to a non American citizen, and due process is not considered when the person isn't a citizen.

The best way to weed out this situation is to have a heart for our country, and our safety. This may seem heartless to some, but, American middle class families are in grave danger of survival. Especially the middle aged, middle class American families, that may not have a retirement fund, because people that recently became citizens, or are illegal aliens, are spending that fund right now.

I do not consider myself a predjudiced person in any way, however as an American citizen my contitutional and civil rights get violated more than they should, and there is no justice for it. The only way to get peace of mind is to write about an opinion. The last thing that the legal American taxpayer wants to hear is an American judge is keeping an illegal alien in the prison system because he is concerned for the man/woman's safety upon deportation. That statement is ridiculous.
