The question truly should be is the tax code and income tax fair or "legal" at all, in the sense the founding fathers never, ever intended the American people to be taxed on the "fruits of their labors," as a direct tax.

The 16th Amendment and it's ratification has been the subject of much dispute by both historians, and those labeled as "tax protestors." In fact, those tax protestors are absolutely correct in their objections to this abridgement of the founder's intent with respect to taxation in this country. Now, not only are there federal "income" taxes but also there is dual taxation then again at the state level. The founder's intended sales or indirect taxes in order to insure freedom once again in this country. The freedom to even somewhat choose the level of your tax bite. In other words, in taxing the purpose of products, or "property" instead it leaves then the freedom to decide whether or not to pay the price, or purchase the product.

That is why there is now also a move in order to replace the "income" tax with a national sales tax instead.

Originally, the founders intended for the federal government simply to operate and pay it's expenses through foreign trade agreements, import taxes, and "use" fees for federal services - such as registration of trademarks and patents. It was the Wilson Administration which actually began America on it's path to socialism in the enactment of both the federal income tax, and also the Federal Reserve Act and passage of the 17th Amendment, which actually then made the state's no more than lobbyists at the federal trough for federal grants. This has also made the states now as representatives of the people, but merely as agents now of the federal government in their progressive violations of citizen's freedoms at the state level due to federal mandates. It centralized all power now in Washington, when as a Constitutional Republic it was the states and the citizens that were to have all power outside the federal government's enumerated ones.

The 10th Amendment was intended to insure that the federal government had no power to overstep it's Constituted authority, and has been ignored by them due to the state's own negligence in asserting those rights when confronted with their federal mandates.

The poor AND middle class have actually borne the brunt of the illegality of the 16th, since the rich and corporate interests have progressively lobbied for and been successful in obtaining loopholes and tax shelters that neither the rich nor middle class can afford.

It's time to abolish the 16th, in order to guarantee the survival of the American people and their posterity once again.
