Critique of America's justice system

of issues relevant to our cases. We discovered the desertion of one of our attorneys when they were mentioned in a newspaper. We wrote a certified letter to the author of the series of articles on the deserting attorney explaining our plight, the letter disappeared with no response. In another case the paper published our street address, in the past we had been terrorized by a stalker (a concern since they published our street address), again we wrote to them describing the situation and again there was no response. This is the press whose responsibility is to dig up "stories", did we have a story or not, they did not bother to find out, did not bother to even respond with a form letter.



I have also written to the ACLU, they too have failed to respond - not even a form letter.



The combination of all these factors results in a system that is a facade, used to deceive the public into believing that there is a functional system. In my discussions on this issue I have been called names, informed that they are human prone to mistakes, that we fell through the cracks, overworked attorneys, overworked courts, the excuses go on as to why they cannot preform their service in a competent, professional manner. In an interesting twist, when we make a mistake we are told that "ignorance of the law is no excuse". This implies that it is okay for "professionals" who are supposed to understand the "law" to commit assault, extortion, fraud - but it is not okay for someone that cares not one whit for the "law" to make a mistake. Usually the end of these discussions result in my being told that I have a case of "sour grapes", to this my response has been "well who sold me the case of sour grapes".



I believe that This is an implementation failure, it is not a failure of the system. It is a failure of the certifying agencies, the "Bar" to ensure that their members are performing up to par. That their members not only have "knowledge" of the legislated laws but actively and competently represent their clients. Since citizens are not allowed recording devices in the courts, the victims of attorney fraud have no proof and there is no mechanism to validate that such fraud occurred - a perfect niche for a scammer. The one institution that could enforce and provide an incentive for their members to perform competently does not when they disregard "strategy" or "performance" complaints. This failure by this institution is a fraud against society, stating standards and not enforcing them.



I have one additional caveat on the "judges" and their one sided rulings. In a couple of situations the judge heard one side and then without hearing the other side, rebuttal, chose to make a judgment. In one case the judge actually argued with the prosecutor about their deal, in that case I was glad for the prosecutor defending the deal - this was the case where the cop lied in his report to get even with me because he did not know why he approached me and I questioned his actions.



Add this to the above issues with representation and this society has an implementation that is a total failure. This dysfunction means that the intent is a scam, law enforcement fertilize the field, attorneys harvest the crop, the courts process it and the associated industries market their stats to justify their budget requirements.
