Divorce 101

The dissolution of a marriage is emotionally trying and known to be one of life's top stressors, having a qualified divorce attorney to guide you through the process will put you in a position of awareness. When a divorce action appears to be pending in your marriage, it is wise to find a divorce attorney as soon as possible.

Divorce law varies state to state. It is important to obtain an attorney early in the process to ensure that your best interests are protected.

The main concerns your attorney will have will pertain to assets, finances, spousal and child support obligations as they pertain to you, and child custody and visitation schedules.

When you are meeting with your attorney, be prepared to disclose and provide documentation concerning the following: any prenuptial agreement you may have signed, (there are no iron-clad prenuptial agreements), current wills for both you and your spouse, property that is jointly owned or obtained during the marriage, financial statements for both you and your estranged spouse including, but not limited to tax returns and bank statements, a complete listing of all debts and expenses.

Hiring a divorce attorney early in the process will protect your rights and interests and provide you with insight as to your future financial situation.

During the divorce process all of your assets will be divided according to state law, custody of any children the marriage produced will be awarded, child support will be scheduled and you will be on the way to living life as a single person again.

In order to start anew, you need to have a well-qualified attorney on your side to make the transition from marriage to single life as smooth as is possible. Once the divorce decree is issued, you cannot go back and modify your divorce settlement. An experienced divorce lawyer will be meticulous in protecting you and your future; do not let the emotional turmoil of the painful situation distract you from your priorities, which are to ensure a continuation of the standard of living you are accustomed to.

For couples with children, custody issues can become battles; protect your parental rights by retaining an attorney who specializes in family law as soon as possible. The custodial parent will often get preference in court when deciding who shall retain the familial home, being proactive in protecting your parental rights from the very beginning of the divorce proceeding will benefit you greatly when issues of support and primary custody are decided.

Your attorney will advise you as to your best course of action in all matters relevant to your divorce. Do not allow your future to be left to chance, protect yourself and your rights by having legal representation at all times during a divorce proceeding.

In cases where one partner is at fault regarding the divorce, that is abuse, adultery, substance abuse, etc., your attorney will find it useful if you can provide documentation of any incidents relative to the problems. This documentation, although painful and embarrassing to provide, can sway a family court judge to make a child custody decision in your favor.

The more organized you are in seeking your divorce, the more likely your success in having the best settlement provided, whether you are a male or female, hire an attorney as soon as you suspect you will be divorcing.

If the marriage reconciles prior to the divorce actually proceeding, you will have a wealth of knowledge should divorce become necessary at a later date.

No one is going to protect you during this process, decisions will be made about your life based on case law, only an experienced divorce attorney can protect your interests.
