Which type of divorce is right for you?

The breaking of a marriage is always tough on both the parties, especially if children are involved. However, once all necessary steps have been taken to save one's marriage, the next step is often legally ending it by taking a divorce. Depending on the way your relationship ended and the state you live in, you can choose between five types of divorces. This article will help you decide which one is suitable for you.

* No-fault Divorce
You can opt for a no-fault divorce if both you and your partner agree that no one is at fault for the failure of the marriage. Simply citing "irreconcilable differences" is enough for filing a no-fault divorce. You don't have to present any further explanations or reasons for filing for a divorce. In most states, even the consent of your spouse is not necessary.

Oklahoma was the first to offer no-fault divorces in 1953. Seventeen years later when finally California passed the no-fault divorce law, a few other states such as Arizona followed suit. Most states now offer no-fault divorces. However, make sure to find out if the no-fault divorce law is available in your state.

* Uncontested Divorce
An uncontested divorce allows you and your spouse to mutually end the marriage. It also allows both the partners to come to a mutual agreement about issues such as how financial assets will be divided and who gets the custody of the children. These types of divorces are very simple and take very little time.

Make sure that you are aware of all your rights before filing for an uncontested divorce. You can end up giving certain rights such as alimony and pension benefits by opting for an uncontested divorce.

* Simplified Divorce
Some states allow simplified divorces. Make sure to find out if your state offers it. Laws may also differ from state-to-state with respect to the requirements. Some states require that there are no minor children involved as a result of the marriage. In some states you might be just required to fill out the necessary forms and get a judge to approve your settlement agreement.

People choose simplified divorces because they are less expensive and less stressful. You also don't need to go to court. They are usually suitable if the duration of your marriage was short, there are no children involved and there aren't any financial assets to divide. Simplified divorces are quick and are granted within 30 days.
