The sad truth of being injured on the job and dealing with Workers Compensation

Workers compensation claims tend to rise in hard economic times as people are looking for some way to get by. A key thing is not to get caught doing any physically demanding tasks that could get you in trouble with the company if caught on tape. Many people know several workers who more than likely lost their worker's compensation cases due to shenanigans like this.

Getting by-There are several things to consider before you file a workmen's compensation suit. Number one being whether or not I can still support my family during the time I am waiting for my case to be heard and I'm not actually at work. During the time of when my father was injured at work and had to file for worker's compensation we as a family barely had enough money to get by. My father had enough money however to buy the luxury items he needed like cigarettes and Mountain Dew. As you are struggling to get by please make sure your family's needs and concerns are being addressed or else they may become resentful.



Do you have a case-Did you really injure yourself at work or were just trying to be macho and slip a disk in your back as you were remodeling your home. This goes hand and hand with lawyer competency. If you have a good lawyer who can file the brief and show up in court for you that is a good thing. They have to go that extra mile for you in order to prove you do have a good worker's compensation case. Sometimes it can be the highest paid, most veteran and overall quite successful lawyers who are so eager to cut a deal with a large corporation. You need someone fighting in your corner who is passionate about what they do in the courtroom.



Have a credible doctor-The company who you are going after will try to throw their doctors at you. Of course these are company employees and more often then not make the decision automatically that you should go back to work. Make sure you have a second opinion from your own doctor. The doctor has to have a near spotless record or they may try and attack them in court. Not having a credible doctor could put your Worker's Compensation insurance in jeporady. Check their patient history, get all kinds of recommendations and read over their credentials.



Make sure the union has your back-Sometimes it can be the people who are suppose to be your best friends that end up double crossing you in the end. Sometimes union bosses can just be out for themselves so you have to watch out for that kind of thing. Occasionally union bosses end up with a nice car and a new boat every few years while you work away for the same wage. It is then that we know something is wrong with the system. Protecting Worker's Compensation Insurance is a key job for any union.




When going through this entire process or trying to claim your Worker's Compensation. If you come unglued it could ruin your whole case. This could come true because the judge could deem as unstable to hand any kind of monetary award you may receive or even unstable as an employee.
