What is a simplified divorce?

by Debbie Paulsen

Created on: November 02, 2008

If You want to get a simplified divorce, without spending a lot of money, or time, it can be done. This does not mean that everyone will be able to smooth the pathway to marital freedom, in a streamlined manner, but for some it may be the way to go.

This path is not recommended when very young children are involved. Children have many years of their future ahead of them. and in this regard careful consideration, with experienced advisers, is in the best interest of everyone involved. If this is not your situation, and you are still looking for a simplified quickie divorce, read on then, by all means.

Pro Se divorce booklets are available through your local womens rights and advocacy centers. They cost on average $25.00. The advice in there, for step by step court procedures, and necessary forms make this an absolute must to proceed, with an uncontested divorce. Armed with this book, as a guide, you will be on your way to a simplified divorce. In the meantime until you get the book in hand, what are a few things you might expect?

The first thing you, and your Ex to be, will have to agree on, is to agree on everything. That is right, everything. In writing. Break it all down. Debts and assets. Make two nice neat files. One file is all of your assets, the other is all of your debts. Do not be surprised if the debt pile ends up larger, this happens to many couples. That is what you will figure out next. What is the true value of the asset items, after you subtract the debt owed on the item.

For example, if you owe $150,000 on your home, but it is valued at $200,00, you have a prospective profit of $50,000.00 dollars available when it is sold. Are you selling? Who is living there until the sale? Are the proceeds a fifty - fifty split? What ever the agreement, put it in writing.

The same must be detailed for assets such as automobiles, boats, recreational vehicles, etcetera. If the item is to be sold for profit, you will need to write out who will be responsible for upkeep of the property until sale is completed. It is also possible for one party, of the quickie divorce, to sign off rights and responsibilities to properties. They will owe nothing, and will be owed nothing.

The court wants detailed, signed, agreements. This process of written agreements must be repeated for all assets. This same paper trail must be created for your debts as well. Who is responsible, for what percentage, and when will it be paid, in writing.

If you can manage to agree to agree, on everything, you can get a simple and quick, stress free divorce. Individual states have their own required separation periods, before a divorce will be granted. This varies, but is on average ninety days. This time can be used to put your paperwork in order.

Good Luck, and don't give up hope, there is someone out there for everybody.
