Yes, Goth kids should be allowed to wear what they want, but theirs is a culture that will ALWAYS be judged.
For those Gothers reading this, you will ALWAYS be judged, BECAUSE your style has so many negative images associated with it. Also, our society at large makes judgments based on what a person wears, no matter WHO you are. Here's a good example:
I know an executive of a huge corporation here in my hometown, and every once in a while, he takes his department out to lunch. Most days they go out on weekdays, with him and his people dressed very nicely; they always get great service, and the staff is friendly. Then one day, him and a few co-workers had worked overtime on a Saturday, and he was dressed in sweats: he had a racquetball game to attend later.
Well he and his people sit down and they wait. And wait. And WAIT. Finally, he gets a waiter over, and they all order the buffet. As they are stepping up to it, the MANAGER says very snidely, why is it you people [meaning people who always order the all-you-can-eat buffet] never order real food?"
And all this because of how they were dressed. If he'd been wearing one of his $500 suits, it would have been a whole different scenario!
So yes, as a part of the Goth culture, you have the right to wear what you want, and not be judged; unfortunately, that's not the way the human psyche works. EVERYONE gets judged by how [s]he looks. It's human nature, and human nature cannot be undone.
