I have worked in restaurants for eight years now. Every one of them has been different, including the chains. These restaurants hire from their location, and usually never get the pick of the litter. The biggest reason is the amount of pay. That is understandable considering you don't have to have a list of references, much less a high school diploma or G.E.D. Imagine spending as many years as I have in this business, with some college education, and having experience as a store manager. I walked into McDonald's and they offered me 8.50 an hour to start. So saying that, I can't imagine too many people with the capabilities getting a better job working at a fast-food restaurant. Most of the time these restaurants are lucky to have a full crew.
While understanding their hiring options, I know what kinds of employees they get. On the next subject, how many people do you know that eat fast food? Granted people would be healthier with out them, but as fast as this world wants everything to be with out doing it them selves, it's kind of hard to say: "Ban the fast food restaurants!" Every time that someone sues one of these places, I am sure it affects the raises or pay of those that are there trying to raise a family or even just take care of themselves, because college is not attainable to them.
So knowing that your order may be not exactly what you want, check it. It's your negligence expecting something you know or think is not going to happen. In defense of companies like McDonald's, it is hard to find good help, and even harder to keep it when it is already a stressful job dealing with people who think that they are better than you because they bring home a bigger paycheck. Don't get me wrong, the best thing about these companies are the customers. I have had many good customers that I considered friends. They are one of the biggest reasons that I have stayed in the business so long.
But every time someone thinks about suing one of these companies, they need to think about their job, and what they have done to their clientele. Do you think it to be acceptable to be sued for someone getting a paper cut because the document you gave them was too sharp? Maybe that staple wasn't fastened properly and it cut someone who takes coumadin because they have a high risk for blood clots, and they end up loosing not a lot but enough blood to be upset? The laws are there to protect people, not from getting the wrong order or getting a boo-boo.

In my opinion, this is a very subjective issue. I do agree that McDonalds should pay compensation for a mistake in service
