Reflections: Abuse survivors and the recovery process

The Incident

The applicant, now forty-two years of age, brings this applicant with respect to assaults and criminal harassment she endured at the hands of the Alleged Offender during the period of March 1998 and March 2000 in the cities of Hamilton and Burlington.

The applicant testified that starting in early March 1998 she began to spend time with the alleged Offender, a police officer, as a friend only, The applicant noted that the alleged offender came into her life during a particularly vulnerable period when she needed a friend. On one occasion in late March 1998 the Applicant was at the Alleged Offender's residence in Hamilton. The Alleged Offender was reportedly intoxicated and began to become verbally abusive. The applicant and the Alleged Offender argued at which point he grabbed her by her shoulders and arms and pushed her to the ground. The applicant stated that she attempted to sever all contact with the Alleged Offender after the incident. The Alleged Offender began a campaign of harassment and stalking behavior that was focused on the Applicant and her daughter the witness.

The Applicant testified that the alleged offender assaulted her on a second occasion when she was standing in line at a grocery store. The Applicant stated that the Alleged Offender approached her at the cashier and proceeded to tell her that she should have called him to take her to the store.

The applicant testified that the Alleged offender Harassed her daughter on a daily basis by following them around the community, making frequent phone calls to their home, intimidating their friends and using his power and position as a police officer to attract negative attention to the Applicant and her daughter.

The Applicant testified that she went to the Halton Regional Police to lay a complaint in March 2000. The Applicant and her daughter were accompanied by the police to their home to get belongings and were advised to go to a safe location until Alleged Offender could be apprehended. At that time the police observed the Alleged Offender's employer and advised them of the pending charges and request of their assistance with locating the Alleged Offender. The Police Witness testified that the detachment commander was cooperative, however the Alleged offender's colleagues were not and had "circled the wagon" by then.

The Alleged Offender appeared at the Halton Regional Police station the next day. The Alleged Offender was lodged in the cell overnight after which he admitted to
